    The Los Angeles Black Worker Center (“LABWC,” “we,” “our,” or “us”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what information we collect, through powerblackworkers.org,  how we use and disclose it, the choices available to you, and how we handle email and SMS communications.

    This Privacy Policy applies specifically to powerblackworkers.org and does not automatically apply to LABWC’s primary website or other websites, platforms, or digital services that maintain separate privacy notices. 

    LABWC is based in California. As a nonprofit organization, LABWC may not be subject to every provision of the California Consumer Privacy Act (“CCPA”), as amended by thewe California Privacy Rights Act (“CPRA”). However, we are committed to responsible data practices and voluntarily provide many of the privacy choices described below. Where applicable law provides additional rights, we will comply with those requirements.

    We collect personal information that you provide to us or that is collected when you interact with our Website.

    If you make a donation or other payment, payment information such as your credit or debit card number is generally collected and processed by our third-party payment processor rather than stored directly by LABWC.

    We do not intentionally request sensitive personal information through the Website unless it is reasonably necessary for a particular program, service or activity. 

    Please do not submit sensitive information through a general contact form unless requested.

    We do not sell personal information.

    We may also collect limited technical and usage information automatically through cookies, analytics tools, our hosting provider, and similar technologies, such as:

    • Pages visited

    • Time spent on the Website

    • Device type

    • Referring website or source

    Making a donation, registering for an event, submitting a program inquiry, or requesting information does not automatically enroll you in all LABWC marketing communications. Where appropriate, LABWC will provide a separate opportunity to request ongoing email or SMS communications. We may still send transactional or administrative messages necessary to complete or respond to your request. 

    We do not sell or rent your personal information.

    We may disclose information to service providers that help us operate the Website and our programs, such as website hosts, donation processors, email platforms, event-registration services, analytics providers, and SMS providers. These providers may use information only as permitted by their agreements with us and applicable law.

    We do not share your mobile number with third parties or affiliates for their own marketing or promotional purposes.

    3. Donations and Payment Processing

    When you make a donation through the Website, your transaction may be processed by a third-party payment platform. That provider may collect payment, billing, and transaction information subject to its own privacy practices.

    LABWC may receive information associated with your donation, such as your name, contact information, donation amount, transaction date, and any preferences or comments you provide. We may use this information to process and acknowledge your gift, maintain required financial records, communicate with you about LABWC, and comply with applicable law.

    LABWC may recognize donors and sponsors in event materials, digital publications, websites, social media, reports, or other communications when appropriate and consistent with the donor’s stated preferences. Donors may request that a gift remain anonymous or that their name not be publicly listed by contacting development@labwc.org.

    Although LABWC will make reasonable efforts to honor anonymity and recognition preferences, certain donation information may still need to be maintained or disclosed for financial administration, auditing, tax reporting, grant compliance, payment processing, or other applicable requirements.

    Making a donation does not automatically constitute consent to receive ongoing fundraising or marketing communications. Donors may select their communication preferences when those choices are provided and may unsubscribe from promotional email at any time.

    4. Email Communications

    If you join our email list, register for an event, make a donation, or otherwise ask to hear from us, you may receive updates, announcements, campaign information, fundraising communications, invitations, and occasional promotional content.

    You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting development@labwc.org.

    Even if you unsubscribe from promotional email, we may still send transactional or administrative communications when necessary, such as donation receipts, event confirmations, or responses to requests you initiate.

    If you join our email list, select an email communication option, or otherwise ask to hear from us, you may receive organizational updates, event announcements, advocacy and campaign information, fundraising appeals, invitations, and information about LABWC’s programs and worker resources.

    When permitted by applicable requirements, LABWC may also contact individuals with whom it has an existing donor, supporter, participant, volunteer, or organizational relationship. We will provide a clear method for opting out of fundraising and promotional email communications.

    You may unsubscribe at any time by clicking the unsubscribe link in an applicable email or by contacting development@labwc.org.

    Even if you unsubscribe from fundraising or promotional email, we may still send necessary transactional or administrative communications, such as donation receipts, tax acknowledgments, event confirmations, program-related notices, or responses to requests you initiate.

    5. SMS / Text Message Policy

    LABWC will send informational or marketing text messages only to individuals who have expressly opted in to receive them. SMS consent will be requested separately and will not be assumed solely because an individual provided a mobile number, made a donation, registered for an event, participated in a program, or submitted a Website form.

    If you expressly opt in to receive text messages from LABWC:

    • Message frequency may vary.

    • Message and data rates may apply.

    • Consent is not a condition of making a donation, registering for an event, participating in a program, or receiving services.

    • You may opt out at any time by replying STOP.

    • For assistance, reply HELP or contact development@labwc.org.

    No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Information may be provided to service providers that support the delivery and administration of LABWC’s text-messaging program, including telecommunications providers and messaging platforms.

    LABWC and its service providers may maintain records documenting when, where, and how SMS consent was obtained, as well as records necessary to process and honor opt-out requests.

    6. Your Privacy Choices

    You may contact LABWC to ask about personal information we maintain about you or to request that we correct or delete that information. Some requests may be limited by financial, grant, tax, security, operational, donor-recordkeeping, program-administration, or other applicable record-retention requirements.

    California residents may have specific rights under California privacy laws depending on whether those laws apply to LABWC in a particular context. Where LABWC is required to provide those rights, we will do so.

    LABWC does not sell personal information or share personal information for cross-context behavioral advertising.

    To make a privacy request, email development@labwc.org with the subject line “Privacy Request.” Please do not include sensitive personal information in your initial email.

    We may take reasonable steps to verify your identity and authority before responding to or completing a request.

    We will not discriminate against you for making a privacy request or exercising a right provided by applicable law.

    7. Data Retention

    We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy and to meet LABWC’s operational, donor-stewardship, program-administration, financial, tax, grant, auditing, security, and applicable recordkeeping obligations.

    Retention periods may vary depending on the type of information, the purpose for which it was collected, applicable requirements, and LABWC’s legitimate organizational needs.

    If you unsubscribe from an email or SMS list, limited contact information may remain in a suppression or consent-management record so that we can document and honor your opt-out request.

    8. Data Security

    We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no online transmission or storage system can be guaranteed to be completely secure.

    9. Children’s Privacy

    The Website is not directed to children under 13, and LABWC does not knowingly collect personal information online from children under 13 without appropriate authorization. If we learn that such information has been collected improperly, we will take reasonable steps to delete it.

    Certain LABWC workforce, educational, or community programs may be available to teenagers or other participants under 18. When information from a minor is required for a particular program or activity, LABWC may provide additional notices, request parent or guardian authorization when appropriate, or use a designated registration process.

    Minors should not submit sensitive personal, employment, medical, legal, or financial information through a general Website form.

    Welcome to the Los Angeles Black Worker Center (“LABWC”). These Terms of Use (“Terms”) govern your use of powerblackworkers.org (the “Website”), a LABWC microsite, and the information, donation opportunities, registrations, and other online services offered through the Website.

    These Terms apply specifically to your use of this Website. Certain LABWC programs, events, trainings, services, or activities may be governed by additional terms, agreements, eligibility requirements, or participant policies

    This Website provides information about LABWC, Black worker organizing and advocacy, programs, events, campaigns, fundraising opportunities, and ways to become involved.

    You may not commercially reproduce, modify, distribute, publish, sell, license, or create derivative works from protected LABWC content without prior written permission, except as otherwise permitted by law.

    Nothing in these Terms transfers ownership of LABWC’s intellectual property or the intellectual property of its licensors to you.

    3. Donations and Other Payments

    The Website may provide opportunities to make charitable contributions to LABWC. Donations are voluntary and are generally nonrefundable. LABWC may, however, correct duplicate charges or processing errors and may issue refunds when required by law or otherwise determined appropriate.

    The Website may also offer event tickets, sponsorships, advertisements, merchandise, or other transactions. These payments may be subject to separate terms, benefits, cancellation provisions, or tax treatment disclosed at the time of purchase.

    Donations and other payments may be processed through third-party payment providers. LABWC does not necessarily receive or retain your complete payment-card information. Your use of a third-party payment service may also be governed by that provider’s terms and privacy policy.

    The tax-deductible portion of a payment, if any, depends on applicable law and whether the donor receives goods or services in return. Any applicable information will be reflected in the acknowledgment, receipt, or other documentation provided for the transaction. Donors should consult their own tax advisers regarding their individual circumstances.

    LABWC reserves the right to decline, restrict, or return a contribution when appropriate or legally required, including when a contribution is inconsistent with LABWC’s mission, values, policies, or legal obligations.

    4. Programs, Events, Trainings, and Activities

    LABWC may offer programs, workshops, trainings, organizing activities, community events, workforce-related opportunities, and other activities.

    Individual programs or events may be subject to additional terms, eligibility requirements, registration requirements, waivers, codes of conduct, or participation agreements. If those requirements conflict with these general Website Terms, the more specific program or event terms will control for that activity.

    LABWC may modify event or program dates, schedules, speakers, locations, formats, or other details when reasonably necessary. Any applicable cancellation or refund terms will be provided through the relevant registration page or communication. 

    Participation does not guarantee specific employment, financial, organizational, legal, or other outcomes.

    Unless expressly authorized, you may not record, livestream, reproduce, or commercially distribute LABWC trainings, meetings, or events or participant communications.

    5. Employment and Workforce Information

    LABWC works to increase access to quality jobs and improve employment opportunities for Black workers. However, information, referrals, trainings, organizing support, or participation in LABWC programs do not constitute a promise or guarantee of employment, placement, promotion, wages, union membership, or any particular employment outcome.

    Employment decisions may ultimately be made by employers, unions, government entities, apprenticeship programs, training partners, or other third parties outside LABWC’s control.

    6. Informational Content and Professional Services 

    Website content is provided for informational and educational purposes only and does not, by itself, constitute individualized legal, financial, medical, tax, employment, or other licensed professional advice.

    LABWC may separately offer or connect individuals with legal clinics, consultations, referrals, or other professional or supportive services. Any such service may be governed by a separate intake process, eligibility requirements, agreement, or notice.

    Viewing or using general Website content does not by itself create an attorney-client, employment, fiduciary, or other professional relationship with LABWC or any participating service provider.
